SC grants leave to appeal plea of Rajuk against Hatirjheel judgement

The Daily Morning Voice Online Desk: The Appellate Division of the Supreme Court (SC) on Monday granted a leave to appeal petition filed by Rajdhani Unnayan Kartipakkha (Rajuk) against the High Court judgment that declared all the commercial infrastructures in Hatirjheel area illegal. A four-member Appellate Division bench headed by Chief Justice Hasan Foez Siddique passed the order after holding hearing on the matter. The infrastructures already raised in the area will not have to be demolished for the time being as the apex court said the status quo imposed on the High Court order, will remain in place.

Attorney General AM Amin Uddin and Advocate Imam Hasan stood for the Rajuk petition, while senior advocate Manjil Morshed argued for the High Court judgment. The High Court on May 24, 2022, released the full text of its judgement passed on June 30, 2021. The High Court in its order said the water and the aesthetic beauty of Hatirjheel are invaluable resources and none should be allowed to spoil those. The High Court had come up with the judgment after holding hearing on a writ petition filed by rights group Human Rights and Peace for Bangladesh (HRPB).
